Abstract

The sports employment relationship has recently been the subject of renewed legislative and jurisprudential attention, which seems to partially question the regulatory framework which has now been consolidated in over forty years of the validity of law no. 91/1981. Although its entry into force has been partially postponed to 1 January 2023, Legislative Decree 28 February 2021, no. 36, laying down the reorganization and reform of the provisions on professional and amateur sports bodies, as well as sports work. Unlike what characterized the previous discipline, the novel wanted to regulate the figure of the sports worker as a unit, according to a notion that intends to overcome the traditional distinction between the professional and amateur sectors, extending the relative labor and welfare law protections to those who were previously defined amateurs. or professionals in fact. The contribution intends to recall the novelty profiles, in light of the criticalities of the previous legislation, verifying the approach taken on the protection of the health of the sportsman also in other national laws.
