Abstract
This essay intends to analyze the scope of the application of the first paragraph of art. 71 of the Third Sector Code, from both a subjective and objective point of view, and to outline the opportunities that may arise also for Amateur Sports Associations, provided that they acquire the status of Third Sector Entity. In fact, the rule is part of the public measures aiming at promoting and supporting Third
Sector entities, and which are adopted on the basis of the activities of general interest pursued by these entities. The note of the Ministry of Labour and Social Policies, responding to a specific case, addresses the issue of balancing the different needs protected by the legislator.
